Eco-Jurisprudence

I have authored a research paper titled “Eco-Jurisprudence Reimagined: Fusing Law, Humanities, and Management for Resilience”, which has been published in the edited volume The Interdisciplinary Nexus: Law, Humanities, and Management, published by University Book House Private Limited, Jaipur (2025). The publication forms part of an interdisciplinary academic collection examining contemporary legal and governance challenges through multiple disciplinary lenses.

Context and Scope of the Research

The research paper engages with the concept of the Anthropocene, a period marked by significant human influence on environmental and ecological systems. Against this backdrop, the paper examines the limitations of conventional environmental regulatory frameworks and explores the need for broader, interdisciplinary approaches to environmental governance.

Drawing upon legal scholarship, humanities perspectives, and management studies, the paper analyses how environmental adjudication and policy-making may be informed by ethical reasoning, institutional design, and governance theory alongside traditional legal doctrine.

Innovative Legal Strategies: Beyond Traditional Eco-Jurisprudence

The paper situates its discussion within the existing framework of Indian environmental jurisprudence, including judicial developments before the Hon’ble Supreme Court of India and specialised environmental fora. It examines themes such as environmental impact assessment, cumulative environmental harm, and the evolving role of constitutional principles in environmental protection.

Reference is also made to comparative and international perspectives to contextualize the challenges faced by environmental legal systems in addressing complex and multi-dimensional ecological issues.

Strategic Environmental Assessment Integration

One of the key innovations discussed is the integration of Strategic Environmental Assessment (SEA) into policy planning processes. Unlike project-specific Environmental Impact Assessments (EIAs) that examine individual developments in isolation, SEA provides a comprehensive framework for evaluating cumulative environmental impacts across multiple sectors and regions.

Interdisciplinary Dimensions

Humanities Perspectives

The research considers how insights from environmental ethics, cultural studies, and narrative theory may contribute to a more inclusive understanding of environmental harm and responsibility, particularly in relation to community participation and indigenous knowledge systems.

Management and Governance

The paper also explores concepts from management science, including adaptive governance, stakeholder engagement, and institutional learning, in the context of environmental regulation and implementation.

Emerging Themes

An aspect of the research engages with the growing role of youth-led environmental advocacy and public interest litigation, examining how constitutional values such as inter-generational equity and sustainable development have been articulated in environmental discourse.

Conclusion

The paper seeks to contribute to academic discussions on environmental law by examining the intersections between law, humanities, and management studies. By adopting an interdisciplinary perspective, it highlights possible approaches for understanding and responding to contemporary environmental challenges within existing legal and institutional frameworks.
